This Tax & Customs Policy governs the tax, duty, and customs compliance terms applicable to all KEPEAK products sold and shipped internationally, including direct-to-consumer shipments, cross-border B2B sales, and fulfillment through third-party logistics (3PL) and Amazon FBA. KEPEAK complies with local tax laws, customs regulations, and international trade rules in all markets where we operate.
1. General Tax Responsibility
- Customer Responsibility for Import Taxes & Duties: For international orders delivered outside the country of origin, the recipient (customer) is legally responsible for paying all applicable import duties, tariffs, value-added tax (VAT), goods and services tax (GST), excise duties, and any customs processing fees imposed by the destination country.
- KEPEAK does not collect import duties or local taxes at checkout for cross-border shipments unless explicitly stated on the product page or during checkout.
- Tax rates, duty codes (HTS), and customs rules vary by country and are subject to change by local authorities. KEPEAK cannot guarantee final tax amounts or customs clearance times.
2. EU & UK VAT Compliance
- European Union: For orders shipped to the EU, VAT may be applied at the local standard rate (e.g., 21% in Belgium/Netherlands) based on the total value of goods plus shipping costs. KEPEAK complies with EU VAT rules including OSS (One Stop Shop) where applicable.
- United Kingdom: Shipments to the UK are subject to UK VAT and import duties in accordance with UKCA and post-Brexit customs requirements. KEPEAK fulfills UK producer and importer compliance obligations.
- Tax Registration: KEPEAK registers for VAT in required EU member states and the UK as needed, ensuring accurate filing and remittance of collected taxes.
3. United States Customs & Tariffs
- Products shipped to the US are classified under appropriate HTS codes in compliance with US Customs and Border Protection (CBP) regulations.
- Import duties, merchandise processing fees (MPF), and harbor maintenance fees (HMF) may apply based on product category, value, and country of origin.
- Tariff Updates: US tariff policies, including Section 301 duties and base tariff rates, are subject to change. KEPEAK updates its customs documentation and pricing accordingly.
- KEPEAK does not engage in misclassification, false origin labeling, or illegal transshipment to avoid tariffs. All customs declarations are truthful, accurate, and fully compliant.
4. Product Classification & Origin
- All KEPEAK products are assigned accurate Harmonized System (HS/HTS) codes based on material, function, and design.
- Country of Origin: Clearly marked on product and packaging as required by trade rules. Origin information is consistent across manufacturing, shipping, and customs documentation.
- Supplier Compliance: Suppliers must provide accurate origin, material, and manufacturing data. KEPEAK maintains traceability for all products to meet customs and regulatory audits.
5. Export Compliance & Documentation
- KEPEAK complies with export control laws, including EAR (US Export Administration Regulations) and local Chinese export rules.
- All international shipments include complete documentation: commercial invoice, packing list, bill of lading/air waybill, and certificates of origin where required.
- For high-value or regulated goods (e.g., batteries, power stations), additional safety, UN38.3, or transport documents are provided as required by carriers and customs.
6. Prohibited & Restricted Shipments
- KEPEAK will not ship to countries/regions subject to international sanctions, embargoes, or trade restrictions.
- Orders with incomplete, false, or misleading recipient information may be canceled to avoid customs delays or seizure.
- If a package is seized, detained, or destroyed by customs, KEPEAK is not liable for refunds or replacements unless the seizure resulted from KEPEAK’s incorrect documentation.
7. Tax Refunds & Cross-Border Adjustments
- Export Tax Refunds: For B2B export shipments from China, KEPEAK applies for export VAT rebates in accordance with Chinese tax regulations (e.g., 9710/9810/9610 modes).
- No Consumer Duty Refunds: Import duties and local taxes paid by customers are non-refundable by KEPEAK. Customers must resolve tax disputes directly with local customs or tax authorities.
8. Policy Updates
KEPEAK reserves the right to update this Tax & Customs Policy to reflect changes in international trade laws, tax rules, or customs requirements. The latest version will be posted on our official website with the effective date updated accordingly.
